IN NO EVENT SHALL THE TOTAL LIABILITY OF VIA 313 TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT, OR OTHERWISE) EXCEED THE AMOUNT PAID BY YOU, IF ANY, THROUGH THE SERVICE DURING THE THIRTY (30) DAY PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED UNITED STATES DOLLARS (USD $100.00), WHICHEVER IS GREATER.

14. Dispute Resolution and Arbitration

Except for disputes that qualify for small claims court, and except as otherwise provided in these Terms, you and Via 313 agree that any Dispute relating in any way to your use of the Service or these Terms shall be resolved through binding and confidential arbitration, rather than in court. The arbitration shall be conducted under the Commercial Arbitration Rules of the American Arbitration Association (AAA), which are available at www.adr.org. The arbitrator shall have exclusive authority to resolve all threshold arbitrability issues, including disputes about the scope, applicability, enforceability, revocability, or validity of this arbitration agreement.
The arbitration will be conducted in the English language. The arbitrator's award shall be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. The prevailing party in any arbitration shall be entitled to recover reasonable attorneys' fees and costs, subject to the arbitrator's discretion.
14.3 Class Action Waiver
YOU AND VIA 313 AGREE THAT EACH PARTY MAY BRING DISPUTES AGAINST THE OTHER ONLY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION OR PROCEEDING. UNLESS BOTH PARTIES AGREE OTHERWISE, THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN MORE THAN ONE PERSON'S OR PARTY'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A CONSOLIDATED, REPRESENTATIVE, OR CLASS PROCEEDING.
14.4 Exception for Small Claims
Notwithstanding the foregoing, either party may bring an individual action in small claims court if the claim qualifies, as an alternative to arbitration, provided the matter remains in such court and is not removed or appealed to a court of general jurisdiction.
15. Term and Termination
These Terms shall remain in full force and effect for as long as you use the Service or maintain an account with Via 313, whichever is longer. Via 313 may, in its sole discretion and without notice or liability, terminate or suspend your access to all or any part of the Service for any reason, including but not limited to:

Via 313 shall not be liable for any failure or delay in the performance of its obligations under these Terms to the extent that such failure or delay is caused by circumstances beyond Via 313's reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, governmental actions or restrictions, civil unrest, strikes or labor disputes, power failures, internet service interruptions, or any other cause beyond our reasonable control (each, a "Force Majeure Event"). In the event of a Force Majeure Event, Via 313 will make commercially reasonable efforts to notify affected customers and resume normal operations as soon as reasonably practicable.
